Business Immigration to Australia

More than ever before, the Australian Government is actively encouraging business immigration and investment migration to Australia. In its 2007-2008 Annual Report, the Australian Department of Immigration and Citizenship (DIAC) stated the following: “Overseas business people who have successful business or investment backgrounds can benefit Australia through job creation, capital transfers and exports. State and territory governments play an active role in selecting business migrants through their sponsorship of 94.7 per cent of all applicants. This sponsorship supports economic development in specific areas of the sponsoring states or territories. All business skills migrants have to demonstrate a commitment to business in Australia, and most applicants have up tofour years on a provisional visa to establish a business.”

An applicant for this category of visa must demonstrate the following:

• That they have an ownership interest in an existing business or businesses overseas or maintain a portfolio of eligible investments.
• That they maintain a daily and hands on management role in that business or businesses.
• The business turnover meets the benchmark required by the Australian Government.
• The visa applicant or the applicant’s spouse either jointly or separately hold enough business and personal assets, available for transfer to Australia, which meets the Australian Government required benchmark.
• The visa applicant demonstrates in their application that they have a genuine and realistic commitment to setting up a business in Australia.

Should the visa holder set up an eligible business in Australia and meet the Australian Immigration Departments criteria, they will be eligible to apply for a Permanent Residency visa in Australia.  Again, such a visa will allow the holder to live and conduct business freely with Australia.
